Welcome! - Financial Services Commission of Ontario

The Financial Services Commission of Ontario (FSCO) was established under the Financial Services Commission of Ontario Act, 1997 (FSCO Act) with a legislative mandate set out in the FSCO Act. 

 

The FSCO regulates the insurance sector; pension plans; loan and trust companies, credit unions and caisses popularies; the mortgage broker sector; co-operative corporations in Ontario that include 12 Categories of Co-operatives :: CLICK HERE and how you may resolve a complaint about a Housing Co-op :: CLICK HERE. In addition, a link to the Co-operative Corporations Act (CCA). 

 

In regards to the non-profit housing co-operative sector, the FSCO advises at the start of the complaint process that you contact in writing the co-op board of directors with the next step requistioning a members' meeting, and then if necessary, contact CHF Canada for assistance.

The FSCO advising to contact CHF Canada...only opens the door in getting the 'runaround' from CHF Canada...and Ken will advise the FSCO that this complaint process step be removed from the FSCO complaint process.    

 

 


If you believe an investigation is needed?

At an annual meeting or at a general meeting called for that purpose, the members can, by passing a resolution, appoint an inspector to investigate the co-operative's affairs and management. A member of the co-operative can also ask a court to appoint an inspector. Please see sections 146 and 147 of the CCA.


If you suspect fraud or dishonesty, you can also ask the police to conduct an investigation.


When may the FSCO get involved?

The Superintendent of Financial Services at FSCO may get involved when the business of the co-operative has been carried on with the intent to defraud, or the co-operative or its directors have acted in an oppressive or prejudicial manner to or in disregard of the security holder's interests. The Superintendent may also get involved when a co-operative was formed or is to be dissolved for a fraudulent or unlawful purpose, or when persons connected with the co-operative have acted fraudulently or dishonestly. Please refer to section 148 of the CCA.

 

 

An example of a response letter in PDF from the FSCO that replied a complaint against the Board of Directors of a Housing Co-operative: 


 

FSCO Annual Reports include Licensing, Monitoring and Enforcement Activities Across the Sectors that it Regulates with Statistics. 

 

In Ken's view, these Reports lack Transparency. Example: Public and Stakeholder Inquires and Complaints Reporting Statistics on Co-operatives include all 13 Categories of Co-operatives reported as Singular Statistics. 

 

You will need to contact the FSCO and make a request for Statistics that specifically relate to 1 Category of Co-operatives, such as Housing Co-operatives.
